You would like to place an order on the website www.officineimmortelle.com (hereinafter the “Site”). We invite you to consult the General Conditions of Sale which you agree to accept when validating your order.
ARTICLE 1 - PURPOSE - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1.1 These general conditions of sale define:
- The terms of sale on the website www.officineimmortelle.com (hereinafter referred to as the “Site”) from which the products distributed by “L’Officine Immortelle” (hereinafter referred to as the “Products”) are marketed, as well as as the rights and obligations of the parties arising from online sales.
The Site www.officineimmortelle.com is referred to as the “Site”. Products “The Immortal Pharmacy” are collectively referred to as the “Products”.
These General Conditions of Sale are concluded between a natural or legal person wishing to make a purchase for their strictly personal use, via the Site (hereinafter referred to as the “Customer”) and the Company. “The Immortal Pharmacy” whose full contact details are as follows:

By placing an order for a Product on the Site, the Customer acknowledges:
- that he has full legal capacity;
- that his order is governed by these General Conditions of Sale of which the Customer declares to accept the terms without restriction or reservations. Any order constitutes acceptance, without reservation, of these General Conditions of Sale. This acceptance is in no way conditioned by a handwritten signature on the part of the Customer. In accordance with the applicable provisions of the Civil Code, it is recalled that the validation of the purchase order as specified in Article 3 constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.
1.2 Any special condition or any other written document contained in particular in documents from the Customer (including the order) cannot prevail over these General Conditions of Sale without the express prior written agreement of “L'Officine Immortelle”. It is specified that the Customer may save or print these General Conditions of Sale, provided however not to modify them.
1.3 “ L’Officine Immortelle ” reserves the right to modify these General Conditions of Sale, which it is up to the Customer to consult regularly. The online version of these General Conditions of Sale on the Site www.officineimmortelle.com will prevail, where applicable, over any other version of the said General Conditions of Sale, with the exception, in accordance with common law, of modifications which may have occurred. following an order from the Customer.
ARTICLE 2 - PRODUCTS
2.1 Presentation and description of “L’Officine Immortelle” Products presents on the Site the different products that it presents for marketing, as well as their detailed descriptions contained in product sheets, offering the customer the possibility of knowing before taking the final order, the essential characteristics of each product that he can buy via the website www.officineimmortelle.com and this, in accordance with the provisions of article L.111-1 of the Consumer Code.
“ The Immortal Pharmacy” makes its best efforts to ensure that the presentation of the Products whose photographs are displayed on the Site are faithful to the original Products.
However, given the method of presentation of the Products on the Internet, it is possible that the impression perceived by the Customer of the photographic representation of the Products does not correspond exactly to the product itself.
The Products comply with current French regulations.
2.2 Availability of Products
2.2.1. The Products are offered while stocks last at the time the order is placed by the Customer. A Product that has become unavailable is indicated as such. It is stipulated that “L’Officine Immortelle” will make every effort to ensure the availability of the entire range of Products offered.
At any time, “The Immortal Pharmacy” reserves the right to modify or no longer market the Products offered on the Site, these modifications having however no impact on the orders that “L’Officine Immortelle” would have accepted before these modifications came into force.
2.2.2. In the event of unavailability of a Product, “The Immortal Pharmacy” will inform the Customer, as soon as possible, by email, of the delivery of a partial order or of the cancellation of his order.
In the event of a partial order, the order invoice is updated according to the products shipped. Payment takes place upon validation of the order.
2.3 Product Prices
The applicable prices are those indicated on the Site at the time the Customer validates their order. Prices are indicated in euros and are inclusive of all taxes. Prices are subject to French Value Added Tax (VAT) applicable on the day of the order.
The Customer is informed that delivery costs will be invoiced in addition to the price of the Products, and that they will be indicated specifically on the order summary and in the order confirmation email. At any time and without notice, “The Immortal Pharmacy” reserves the right to modify the price of its Products without these modifications having any impact on the orders that “The Immortal Pharmacy” would have been accepted before the entry into force of these modifications.
ARTICLE 3 - ORDER PROCESS AND PAYMENT CONDITIONS FOR PRODUCTS
3.1 Order a Product
3.1.1 To place an order on the Site, the Customer must:
- Have the legal capacity to contract
- Have an address in one of the delivered countries
- Hold a funded bank account allowing them to pay the amount of their order online
In order to add a Product to their basket, the Customer will click on the “Add to basket” icon.
At any time, the Client may:
- obtain a summary of the Products he has selected or modify his basket, by clicking on the “Basket” icon accessible on each page
- validate your basket by clicking on “Pay”.
3.1.2 Once their basket has been validated, the Customer must identify themselves.
The Client undertakes in particular to indicate:
- their last name(s), first name(s), telephone number and email address. Said email address must be perfectly valid and in perfect working order.
- a postal address to which delivery can be made during business hours from Monday to Saturday.
The information requested when placing an order is necessary so that “The Immortal Pharmacy” can confirm his order(s) and send it to him.
3.1.3 Once the Customer has been identified, an order summary will include all the information relating to this order.
3.1.4 After reading the summary of their order, the Customer will be invited:
- either to click on the “Continue” button in order to pay for your order; Then checked the box “I have read and accept the General Conditions of Sale and Use”.
-either to click on the “Return to the previous step” button in order to modify the characteristics of their order and/or the information relating to their personal contact details.
3.1.5 In order to pay, the Customer is invited to click on “Confirm my purchase” and will be invited to make the payment by providing their bank details.
3.1.6 Data recorded for delivery and invoicing by “The Immortal Pharmacy” constitute proof of all transactions passed between “The Immortal Pharmacy” and the Customer. In the event of a conflict between the Parties over a transaction carried out on the Site, the data recorded by “L’Officine Immortelle” are considered irrefutable proof of the content of the transaction. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.
3.2 Payment of the order
Payment will be made in euros exclusively by bank card (CB, Visa, MasterCard, American Express), to the exclusion of any other means of payment. The Customer's bank account is debited at the time of confirmation of the purchase.
In order to make the payment due, the Customer must provide their bank card number, its expiry date accompanied, if applicable, by the visual cryptogram.
The Customer's bank details are requested for each order. In addition, the payment can be validated after entering a 3D Secure code provided by the bank of the Customer holding the Bank Card and communicated by SMS.
To this end, the Client guarantees “The Immortal Pharmacy” that he has the authorizations possibly necessary to use the payment instrument chosen at the time of validation of his order.
In the context of Internet payments, a check is carried out online with the competent banking establishments and organizations, queried via the Stripe company system. This company, located in the United States, will store and automatically process information relating to each Order, including bank card details, in a secure environment. The transfer of the customer's personal data to Stripe is governed by the standard contractual clauses established by the European Commission.
In the event of refusal by the bank, the order will be automatically canceled and the Customer informed by “The Immortal Pharmacy”
“The Immortal Pharmacy” uses a payment provider and therefore never has access to confidential information relating to the Customer's means of payment.
3.3 Security in payment transactions and securing means of payment
In order to fight against Internet fraud, the company “The Immortal Pharmacy” implements processing relating to risk assessment and prevention of payment fraud for purchases on the Site, for which the company “The Immortal Pharmacy ” also uses the company Stripe. The data collected is intended only for authorized persons responsible for combating fraud within the company. “The Immortal Pharmacy”.
As part of the fight against Internet fraud, information relating to the Customer's Order may be transmitted to any third party authorized by law or designated by “The Immortal Pharmacy” for the sole purpose of verifying the identity of the Customer, the validity of the Order, the payment method used and the planned delivery. To follow up on this control, “The Immortal Pharmacy” reserves the right to request a photocopy of the Customer's identity card and/or any information relating to the Customer's identity. All Customers have the right to access, rectify and delete personal data concerning them and processed by “L’Officine Immortelle” , under the conditions provided for by the “Personal Data” charter.
All transactions are carried out on the Site in a secure manner. Indeed “The Immortal Pharmacy” uses an SSL protocol. The information communicated when placing the order will not be stored on the servers of “The Immortal Pharmacy” .
3.4 Confirmation of the order by “The Immortal Pharmacy”.
3.4.1 The order for Product(s) will only be considered firm and final once it has been confirmed by “The Immortal Pharmacy”. Once the order for Product(s) has been confirmed and its payment validated, a printable and saveable summary of the Customer's order is displayed which mentions the order references.
3.4.2 An order confirmation email will then be sent to the Customer and will include the following information:
- the order number;
- the order summary (designation of the Product(s) ordered, quantity, price and essential characteristics);
- the legal rights and guarantees available to the Customer;
- the total amount of the order, all taxes included;
- delivery fees ;
- confirmation of payment;
- the terms relating to the delivery of the Products ordered (expected shipping time which may not exceed a maximum of fifteen (15) days from validation of the order).
3.4.3 In accordance with the provisions of article L.122-1 of the Consumer Code, “The Immortal Pharmacy” will be entitled to refuse any abnormal order, placed in bad faith, or unpaid due to fraudulent use of a bank card.
ARTICLE 4 - DELIVERY & RECEIPT OF THE ORDER
“The Immortal Pharmacy” retains ownership of the Products ordered until full payment of the corresponding price.
4.1 Delivery to the Customer
Products ordered by the Customer on the Site www.officineimmortelle.com will be delivered exclusively in mainland France, (Corsica and Monaco not included),
The Customer will be able to follow the progress of the delivery of his order via a hyperlink allowing access to an Internet page which will be communicated to him upon confirmation of the shipment of his order.
Delivery is made to the delivery address indicated by the customer, it being specified that this must be the residence address of the customer or any other natural person of their choice domiciled in mainland France.
In order for these deadlines to be respected, the customer must ensure that they have communicated accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes , names and/or intercom numbers, etc.).
The deadlines indicated are indicative deadlines, corresponding to the average processing and delivery times.
“The Immortal Pharmacy” cannot be held responsible for the consequences due to a delivery delay not due to its fault.
In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and the company “L’Officine Immortelle ” , by all means, all reservations within 2 days following receipt of the product. Delivery of orders is carried out by a subcontracting carrier .
Delivery being ensured by a third party service provider, the Customer acknowledges and accepts that “L'Officine Immortelle” cannot be held responsible in any way if the non-performance or poor performance of this obligation is attributable to the Client or to the actions of a third party to the contract or to a case of force majeure.
4.2 Product delivery times
L'Officine Immortelle ships your items as soon as possible, but it will not always be the same day as your order. Typically, please add 2-3 business days to allow for processing. Orders are not shipped or delivered on weekends or holidays. If we experience a high volume of orders, shipments may be delayed a few days. Additionally, factor in a few extra days for delivery. 4.3 Late delivery
Any delay in delivery must be reported in writing as soon as possible by the Customer to “L’Officine Immortelle” which will carry out a survey of the carriers concerned. The Customer will have the right to cancel his order if delivery has not occurred at the latest on the delivery date initially indicated to the Customer and subject to a delay resulting neither from the Customer nor from a case of force majeure.
From the exercise of the right of denunciation, or the conclusions of the investigation carried out by “The Immortal Pharmacy ” confirming the loss of the package, “The Immortal Pharmacy” will make a refund to the bank account debited when ordering, within a maximum period of fourteen (14) days from receipt of the complaint, to the exclusion of any other compensation, or will reship the Products at its expense if the order has not been denounced by the Customer.
In the event of partial delivery of the order, delivery may be made in several installments, and this right will only concern the undelivered balance of the order.
4.4 Receipt of the Products by the Customer
Each delivery is deemed to have been made as soon as the Products are made available to the Customer by the carrier, materialized by the control system used by the carrier. No dispute relating to the delivery itself will be possible if the package appears to have been delivered, the carrier's computer system being taken as proof.
Without prejudice to the deadlines available to the Customer under their right of withdrawal as specified in Article 5 below, it is up to the Customer to:
• Unpack the package in the presence of the delivery person
• Enter detailed handwritten reservations on the Delivery Note. The reservations made by the recipient upon delivery constitute means of proof of the existence and extent of the damage. The Client must ensure that their writing is precise and complete (the simple statement “subject to unpacking” is considered too general and imprecise), and
• Notify your carrier by registered letter with acknowledgment of receipt of a letter of protest within three (3) days of receipt in accordance with the provisions of article L.133-3 of the Commercial Code),
• Inform “L’Officine Immortelle” by email or registered mail within three (3) working days following delivery of the Order.
Any reservation of this type must also be notified to the Customer Service of “L’Officine Immortelle” , whose contact details appear on the Site, within the same period and in the same form. In this regard, the Customer will take care to attach to his shipment a copy of the complaint addressed to the carrier.
ARTICLE 5 - CUSTOMER’S RIGHT OF WITHDRAWAL
5.1 Products “The Immortal Pharmacy”
The customer is informed and acknowledges and accepts that “L'Officine Immortelle” distributes perishable foodstuffs with a minimum durability date (DDM).
Regarding “L'Officine Immortelle” Products falling within the food category of perishable foodstuffs ordered on the Site, in accordance with the provisions of article L. 221-18 of the Consumer Code, and subject to the hypotheses referred to in article L.121-21-8.4° of the said Code, the Customer does not have the right of withdrawal provided for in article L.121-21 of the Consumer Code.
5.2 Limits and exclusions of the right of withdrawal
In accordance with article L.221-28 of the Consumer Code, the Customer will not be able to exercise the right of withdrawal for:
- Products made according to the Customer's specifications or personalized at their request;
- Products which, due to their nature, cannot be returned or are likely to deteriorate or expire quickly;
- Products which have been unsealed by the Customer after delivery and Products which cannot be returned for reasons of hygiene or health protection.
ARTICLE 6 - LEGAL GUARANTEES
“The Immortal Pharmacy” respectively guarantees that the Products “The Immortal Pharmacy” are compliant with the expected use, and do not present any defects or hidden defects making them dangerous or unfit for their normal use. Thus, all products on sale on the Site benefit from the legal guarantee of conformity (as defined in articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (as defined in articles 1641 and following of the Civil Code), allowing the Customer to return defective or non-compliant products delivered free of charge.
6.1 Legal guarantee of conformity
Article L.217-4 of the Consumer Code states that “the seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.
Article L217-5 of the Consumer Code states that: “The good complies with the contract:
1° If it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model; - if it presents the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted. » Article L217-12 of the Consumer Code states that “the action resulting from the lack of conformity is prescribed two years from the delivery of the good”.
6.2 Guarantee against hidden defects
Article 1641 of the Civil Code provides that "the seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which so diminish this use, that the buyer would not have acquired it, or would have given only a lower price for it, if he had known them.”
Article 1648 of the Civil Code provides that “the action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. In the case provided for by article 1642-1, the action must be brought, under penalty of foreclosure, within the year following the date on which the seller can be released from apparent defects or lack of conformity.
6.3 Exclusion of guarantees
Products modified, repaired, integrated or added by the Customer are excluded from the warranty. The warranty does not cover apparent defects. The warranty will not cover products damaged during transport or due to misuse.
6.4 Modalities for implementing legal guarantees
When acting as a legal guarantee of conformity, the Customer:
- benefits from a period of nine months from delivery of the goods to act;
- can choose between repairing or replacing the goods, subject to the cost conditions provided for by article L217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the six months following delivery of the goods.
The legal guarantee of conformity applies independently of any commercial guarantee granted.
The Customer may decide to implement the guarantee against hidden defects in the item sold within the meaning of article 1641 of the civil code. In this case, he can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the civil code.
For any request regarding legal guarantees, the Customer must contact Customer Service by email: hello@officineimmortelle.com . These provisions do not exclude the right of withdrawal defined in article 5 above.
6.5 Consequence of the implementation of guarantees
As part of the legal guarantee of conformity, “L’Officine Immortelle” undertakes at the Customer's choice:
- either to replace the Product with an identical product depending on available stocks,
- or to reimburse the price of the Product, within a maximum period of 30 days, if the replacement of a product proves impossible.
As part of the legal guarantee against hidden defects, “The Immortal Pharmacy” undertakes at the Customer's choice, after evaluation of the defect:
- either to reimburse the entire price of the returned product, within a maximum period of 30 days,
- or to reimburse part of the price of the product, within a maximum period of 30 days, if the Customer decides to keep the product.
ARTICLE 7 - COMMERCIAL GUARANTEES
7.1 Right of return
In the event of receipt of a non-compliant Product, and subject to the provisions of article 5.2, the Customer is authorized to return the non-compliant Product to “L'Officine Immortelle” within thirty (30) days after receipt of the Product.
In this regard, it is specified that “The Immortal Pharmacy” does not accept parcels sent postage collect, and that the Product must be returned in its original packaging. The Customer will attach to his package a copy of the invoice as well as the return slip sent by the customer relations department which he will have previously requested by email: hello@officineimmortelle.com
“L’Officine Immortelle” will carry out a check on the non-conformity of the Product which, if confirmed, will automatically result in a refund for the benefit of the Customer. This reimbursement will be made to the bank account debited when ordering the Product within thirty (30) days after receipt by “The Immortal Pharmacy” of the non-compliant Product. This refund will also include the reimbursement of the initial delivery costs if all of the Products delivered are returned. If the entire order is not returned in its entirety, no refund of the original delivery charge will be made.
Any risk linked to the return of the Product remains the responsibility of the Customer.
7.2 Right of exchange
In the event of receipt of a non-compliant Product, and subject to the provisions of article 5.2, the Customer is authorized to exchange the non-compliant Product with “The Immortal Pharmacy” within thirty (30) days after receipt of the Product concerned.
ARTICLE 8 - RESPONSIBILITY OF “L’Officine Immortelle”
The responsibility of “The Immortal Pharmacy” cannot be held liable for any inconveniences or damages inherent to the use of the Internet network, in particular a break in service, occurrence of bugs, external intrusion or the presence of computer viruses.
Without prejudice to the provisions of the preceding paragraphs, the responsibility of “L'Officine Immortelle” , under the terms of these General Conditions of Sale, cannot be held liable, in any joint case, and cannot exceed a sum equal to the sums paid or payable during the transaction giving rise to said liability for the “L’Officine Immortelle ” products for those whom it concerns “The Immortal Pharmacy” , whatever the cause or form of the action concerned.
ARTICLE 9 - INTELLECTUAL PROPERTY
9.1 Copyright
The Site is the full and complete property of “The Immortal Pharmacy” . The latter holds the intellectual property rights necessary to put them online.
Both the general structure of the Site (graphic charter) and its content (texts, slogans, graphics, images, sounds, videos), including software, databases and newsletters (hereinafter the “Content”) are the property of “L’Officine Immortelle” or third parties authorized to use them, and are protected by copyright. These do not grant any license or any right other than that of consulting the Site. The reproduction of all or part of the Site and its Content is only authorized for the exclusive purposes of information for personal and private use.
Therefore, in accordance with the provisions of the Intellectual Property Code, any representation, reproduction, modification, denaturation and/or of the Content, by any process whatsoever and on any medium whatsoever, without the express prior authorization of “L’Officine Immortelle” is prohibited and constitutes an act of copyright infringement.
Likewise, any unauthorized exploitation of the Site and/or its Content engages the criminal and civil liability of the User on the basis of copyright infringement.
9.2 Distinctive signs
The brands, logos, company names, acronyms, trade names, signs and/or domain names of “The Immortal Pharmacy” and/or its commercial partners mentioned on the Site constitute distinctive signs which cannot be used without the express prior authorization of their holder.
Any representation and/or reproduction and/or partial or total exploitation of these distinctive signs is therefore prohibited and constitutes trademark counterfeiting, in application of the provisions of the Intellectual Property Code.
9.3 Hypertext links
The hypertext links implemented within the Site towards other sites, and in general towards all existing resources on the Internet, cannot engage the responsibility of “The Immortal Pharmacy” .
Any creation of links to the Site, any framing of the Site, and more generally any use of the Content, is subject to the prior and express authorization of “The Immortal Pharmacy” which may be revoked at any time at their sole discretion. “The Immortal Pharmacy” reserves the right to request the removal of any link to the Site which has not been, or is no longer, authorized and to request damages to compensate for the harm suffered as a result.
ARTICLE 10 - COMPUTING AND FREEDOMS
“The Immortal Pharmacy” collection of the Customer's personal data, as well as, where applicable, those of the recipient of the Order. The Customer is informed that this automated processing of information has been declared to the CNIL. The purposes, recipients and conditions under which “The Immortal Pharmacy” collection and processing of personal data are presented in the “Personal Data Charter” of the Site.
“The Immortal Pharmacy” has implemented security measures to protect the personal information you provide from unauthorized access and use. All financial information that you provide on the Site is stored on the secure site of the financial institution chosen by “The Immortal Pharmacy” . Transactions concluded on the Site are protected by an encryption process. Please be aware, however, that no data transmission over the Internet is 100% secure and any information communicated online can potentially be intercepted and used by others than the intended recipient.
Any personal data is subject to the provisions of Law No. 78-17 of January 6, 1978, as amended. As such, you have the right to access and have data concerning you processed by “ L’Officine Immortelle” , as well as the right to object to the processing of this data for direct commercial prospecting purposes, by contacting our Customer Services, by email, at the address hello@officineimmortelle.com .
If applicable, you must provide “The Immortal Pharmacy” updates or changes to information about you, including in particular that relating to your postal and/or electronic address in order to allow us to ship your orders to the correct address and to contact you about it in the event of need.
ARTICLE 11 - FORCE MAJEURE
Neither the Client nor “The Immortal Pharmacy” cannot be held responsible for the total or partial non-performance of their obligations, if this non-performance is due to a fortuitous event or the occurrence of an element constituting force majeure such as in particular, and without this list being limitation, flood, fire, storm, lack of raw materials, transport strike, partial or total strike, or lockout, these different elements being assessed in relation to the applicable case law.
The party having been affected by such events must inform the other party as soon as possible and at the latest within five (5) working days of the occurrence of this event.
The Customer and “The Immortal Pharmacy” agree, in which case, to consult as soon as possible in order to jointly determine the terms of execution of the order during the duration of the force majeure event.
ARTICLE 12 - PARTIAL NON-VALIDATION
If one or more stipulations of these General Conditions of Sale are held to be invalid or declared such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will remain in full force and effect. their strength and scope.
ARTICLE 13 - NON WAIVER
The fact that one of the parties to these General Conditions of Sale has not required the application of any clause, whether permanently or temporarily, can in no case be considered as a waiver of the rights of this part arising from the said clause.
ARTICLE 14 - ENTIRE CONTRACT
These General Conditions of Sale, the General Conditions of Use and the order summary sent to the Customer form a contractual whole and constitute the entirety of the contractual relations between the Parties. In general, there is provision for an express agreement between “The Immortal Pharmacy” and the Customer that emails will be authentic between them as will the automatic recording systems used on the Site, in particular as to the nature and date of the order.
The Client may access, where applicable in accordance with the rules of common law, the electronic contract concluded between the Client and “The Immortal Pharmacy” .
To do this, he must contact Customer Service by email to whom he will provide all the information necessary to do so, in particular the order number and contact details.
ARTICLE 15 - CUSTOMER SERVICE – MEDIATION SERVICE

ARTICLE 16 - APPLICABLE LAW - DISPUTES
The law applicable to these General Conditions of Sale and to related orders is French law.
Subject to contrary provisions of the code of civil procedure, Any dispute which may arise concerning the validity, interpretation or execution of these general conditions of sale and which has not been settled amicably by the parties hereto , will be submitted to the FRENCH courts, notwithstanding plurality of PARTIES, summary proceedings or expertise.
